Credit Repair Services | Real Estate Services | New Jersey & Georgia

Effective Date: July 2026 | Last Revised: July 2026

These Terms of Service ("Terms"), together with all associated policies incorporated herein by reference, constitute a legally binding agreement between The Phoenix Collective ("Company," "we," "us," or "our") and you ("Client" or "you") governing your use of our website at thephoenixcollective.group and all services offered, including credit repair services and real estate services in New Jersey and Georgia.

By using this website, submitting an inquiry, signing a Service Agreement, or purchasing any service, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree, do not use this website or engage our services.

    1. Services Offered

The Phoenix Collective offers the following professional services:

    • Credit Repair Services: Consultation, analysis, and dispute facilitation services designed to assist clients in identifying and challenging inaccurate, incomplete, or unverifiable information on their consumer credit reports in accordance with the Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq.
    • Real Estate Buying Services: Licensed real estate buyer representation in the States of New Jersey and Georgia.
    • Real Estate Selling Services: Licensed real estate listing and seller representation in the States of New Jersey and Georgia.
    • Real Estate Consulting: Strategic advisory services related to property acquisition, disposition, investment analysis, and market guidance in New Jersey and Georgia.

    2. Federally Required Credit Repair Disclosures (CROA)

The following disclosures are required by the Credit Repair Organizations Act, 15 U.S.C. § 1679c. Please read them carefully before engaging our credit repair services.

    • Consumer Credit File Rights: You have a right to dispute inaccurate information in your credit report without the assistance of a credit repair organization. You may contact each of the three major consumer reporting agencies directly: Equifax (1-800-685-1111), Experian (1-888-397-3742), and TransUnion (1-800-916-8800). You have the right to obtain a free copy of your credit report from each agency once every 12 months at AnnualCreditReport.com or by calling 1-877-322-8228.
    • What We Can and Cannot Do: We cannot remove accurate, current, and verifiable negative information from your credit report; we cannot guarantee any specific improvement to your credit score or credit profile; we can dispute information that is inaccurate, incomplete, or unverifiable on your behalf; we can provide guidance on credit-building strategies and best practices; and we can assist you in understanding your rights under the FCRA.
    • No Advance Payment: In compliance with the Credit Repair Organizations Act (15 U.S.C. § 1679b(b)), The Phoenix Collective will not charge or accept any payment for credit repair services before those services have been fully performed. Any agreement that requires payment before services are rendered is void and unenforceable under federal law.
    • Three-Day Right to Cancel: Pursuant to 15 U.S.C. § 1679e, you have the right to cancel any contract for credit repair services without penalty or obligation within three (3) business days from the date you signed the contract. To cancel, you must notify The Phoenix Collective in writing.

    3. No Guarantee of Results

The Phoenix Collective makes no guarantee, warranty, or representation, express or implied, that any specific outcome will result from its credit repair services. Specifically, we do not guarantee any improvement in your credit score, removal of any specific item from your credit report, approval for any credit product, loan, mortgage, or financing, any specific timeline for results, or that disputes will be resolved in your favor. Credit repair outcomes depend on the responses of third-party credit bureaus and creditors, which are entirely outside of our control. Individual results will vary.

    4. Payment Terms & No-Refund Policy

    • All fees for services are set forth in the applicable Service Agreement signed by the Client.
    • For credit repair services, all fees are charged only after services have been rendered, in compliance with CROA.
    • For real estate consulting services, payment terms are specified in the individual consulting agreement.
    • Real estate transaction commissions are governed by the applicable buyer or listing agreement and state law.
    • All fees are in U.S. Dollars. Returned or dishonored payments may incur a $35.00 returned payment fee.
    • Except as required by federal law (including CROA's 3-day cancellation right) and applicable state law, all payments made to The Phoenix Collective are non-refundable.
    • Initiating a chargeback or payment dispute through your bank or credit card company without first contacting us to resolve the matter is a breach of these Terms.

    5. Real Estate Services - Disclosures & Limitations

    • Licensing: The Phoenix Collective operates with licensed real estate professionals in the States of New Jersey and Georgia. Our agents are bound by the laws, regulations, and codes of ethics of their respective state licensing boards.
    • Agency Disclosure: Prior to entering into any buyer or seller representation agreement, we will provide you with the required agency disclosure forms as mandated by New Jersey and Georgia law.
    • No Guarantee of Outcome: We do not guarantee the sale of any property, any specific sale price, or any specific timeline for sale or purchase. Any comparative market analyses (CMAs), price opinions, or projections provided are estimates only and do not constitute appraisals.
    • Third-Party Professionals: We may refer you to third-party professionals including lenders, inspectors, appraisers, title companies, attorneys, and contractors, but we do not warrant, guarantee, or take responsibility for their services, fees, advice, or conduct.

    6. Client Responsibilities

    • Provide accurate, complete, and truthful information required for the performance of services.
    • Respond to requests for documentation, signatures, and information in a timely manner.
    • Grant necessary authorizations for us to access your credit reports and communicate with credit bureaus on your behalf.
    • Refrain from requesting that we take any action that violates federal or state law.
    • Keep your contact information current.
    • Confirm that you are engaging our services for your own benefit, not on behalf of an undisclosed third party.

    7. Limitation of Liability

To the maximum extent permitted by applicable law, The Phoenix Collective's total cumulative liability to you for any and all claims shall not exceed the total amount actually paid by you to the Company in the six (6) months immediately preceding the event giving rise to the claim. In no event shall we be liable for any indirect, incidental, or consequential damages, loss of profits, revenue, or business opportunities, loss of credit score, credit standing, or creditworthiness, emotional distress or reputational harm, actions or inactions of third-party credit bureaus, creditors, or lenders, or delays or failures resulting from factors outside the Company's control.

    8. Disclaimer of Warranties

The services provided by The Phoenix Collective are offered on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that services will achieve any particular credit score improvement, result in the removal of any specific item from any credit report, that the website will be error-free or uninterrupted, or that any real estate transaction will close on a specific timeline or at a specific price.

    9. Indemnification

You agree to defend, indemnify, and hold harmless The Phoenix Collective, its owners, members, officers, employees, agents, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your breach of any provision of these Terms, your violation of any applicable law or regulation, false or misleading information you provided, your misuse of our services, or any third-party claims arising from your actions or omissions.

    10. Confidentiality & Privacy

The Phoenix Collective collects personal and financial information necessary to provide the requested services, including but not limited to your name, address, Social Security Number (for credit report access), income information, and property details. This information is used solely for the purpose of delivering the contracted services. We will not sell, rent, or share your personal information with unaffiliated third parties except as necessary to perform the contracted services, as required by law, or with your express written consent.

    11. Intellectual Property

All content on this website - including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, and software - is the exclusive property of The Phoenix Collective and is protected by applicable U.S. and international copyright, trademark, and other intellectual property laws. You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of this website or its content without our express prior written permission.

    12. No Legal or Financial Advice

Nothing on this website or in any communication from The Phoenix Collective constitutes legal advice, tax advice, financial advice, or investment advice. We are not a law firm, accounting firm, financial advisory firm, or credit counseling agency. No attorney-client relationship, financial advisory relationship, or fiduciary duty (other than as specifically required by real estate agency law) is created by your use of this website, receipt of our materials, or engagement of our services. You are strongly encouraged to consult with licensed attorneys, certified public accountants, and financial advisors before making decisions based on information provided by the Company.

    13. Dispute Resolution - Mandatory Arbitration

    • Informal Resolution First: Before initiating any formal dispute, you agree to contact The Phoenix Collective at support@thephoenixcollective.group and provide a written description of your dispute. Both parties agree to make a good-faith effort to resolve disputes informally before pursuing formal proceedings.
    • Binding Arbitration: If the dispute cannot be resolved informally within thirty (30) days, all disputes shall be resolved by binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify. Arbitration shall be conducted by a single neutral arbitrator under the rules of the American Arbitration Association (AAA) or JAMS, in New Jersey unless both parties agree otherwise. You waive your right to a jury trial and to participate in class action litigation.
    • Class Action Waiver: All claims must be brought in the parties' individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

    14. Governing Law & Jurisdiction

These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict-of-law principles, except where federal law (including CROA and the FCRA) applies. For any matters not subject to mandatory arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in New Jersey.

    15. General Provisions

    • Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall continue in full force and effect.
    • Entire Agreement: These Terms, together with your executed Service Agreement and any other written agreements between you and The Phoenix Collective, constitute the entire agreement between the parties.
    • Modification of Terms: We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of our website or services following any modification constitutes your acceptance of the updated Terms.
    • Waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
    • Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.
    • Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
